Terms of service

Terms of Service

These Terms of Service apply when you use this website or purchase products from TA ONLINE RETAIL LTD (“we”, “us” or “our”). Our company and contact details are provided on our Contact Information page.

By placing an order, you confirm that you have read and agree to these terms. Nothing in these terms limits your statutory rights under UK consumer law.

Products

We take reasonable care to describe and display products accurately. Colours and appearance may vary slightly because of screen settings, lighting and manufacturing variations.

Product measurements are approximate unless stated otherwise. Please check dimensions and product information before ordering.

Products are subject to availability. We may correct genuine errors in descriptions, prices or availability before accepting an order.

Orders and contract formation

Submitting an order is an offer to purchase. An automated order acknowledgement confirms that we received your order but does not necessarily mean it has been accepted.

A contract is formed when we confirm acceptance or dispatch the order. We may decline or cancel an order before dispatch for reasons including unavailable stock, payment problems, suspected fraud, pricing errors or delivery restrictions. If payment has been taken for an order we cannot fulfil, we will refund it.

Please check your order and delivery details before payment and contact us promptly if a correction is needed.

Prices and payment

Prices are displayed in pounds sterling and include applicable taxes where required. TA ONLINE RETAIL LTD is not currently VAT-registered, so no separate VAT invoice is provided.

Delivery charges, if any, are displayed before payment. You must provide valid and accurate billing and payment information.

Payments are processed securely by Shopify and the payment providers offered at checkout. We do not directly store complete payment-card details.

Delivery

Delivery areas, costs and estimated times are set out in our Shipping Policy.

Risk in the goods remains with us until they are delivered to you or to a person you nominate to receive them. Ownership passes when we have received full payment and the goods have been delivered.

Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Return and Refund Policy.

Nothing in these terms excludes rights provided by the Consumer Contracts Regulations 2013, the Consumer Rights Act 2015 or other applicable consumer law.

Faulty, damaged or incorrect goods

Goods must be of satisfactory quality, fit for purpose and as described. If an item is faulty, damaged or incorrect, contact us using the details on our Contact page.

We may request photographs or other reasonable information to investigate the issue. This does not reduce your statutory rights.

Website use

You must not misuse the website, interfere with its security or operation, introduce malicious code, attempt unauthorised access, use automated systems in a way that places an unreasonable load on the website, or use the website for unlawful or fraudulent purposes.

We may restrict access where reasonably necessary to protect customers, the business or the website.

Intellectual property

The website and its content—including text, layout, graphics and branding—are protected by intellectual-property laws. You may use the website for personal shopping and may not reproduce or commercially exploit its content without permission.

Third-party names, trademarks and product materials remain the property of their respective owners.

Third-party services

Our store is hosted by Shopify. We may also use payment providers, fulfilment partners, couriers and other service providers to operate the store and fulfil orders.

Links to third-party websites are provided for convenience. We are not responsible for third-party content or services outside our control, although this does not affect our responsibilities for orders placed with us.

Privacy

Our collection and use of personal information are explained in our Privacy Policy. Cookie choices can be managed through the consent controls provided on the website.

Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of your statutory consumer rights.

For foreseeable losses caused by our breach of these terms, we are responsible only to the extent required by law. We are not responsible for business losses arising from a consumer purchase or for losses that were not reasonably foreseeable when the contract was formed.

Events outside our reasonable control

We are not responsible for delay caused by circumstances outside our reasonable control. We will take reasonable steps to minimise the effect of any delay and will contact you where it materially affects your order. Your statutory rights, including rights concerning delayed delivery, remain unaffected.

Changes to these terms

We may update these terms to reflect changes in law, our services or business practices. The terms applying to an order are those available when the order is placed, unless a change is required by law.

Severability

If any part of these terms is found unlawful or unenforceable, the remaining provisions will continue to apply.

Governing law

These terms are governed by the law of the part of the United Kingdom in which you live. Consumers may bring proceedings in the courts that have jurisdiction where they live.
